Vertragsgegenstand des Application Service Providing-Vertrages ist die Bereithaltung von Softwareanwendungen zur Online Nutzung über das Internet oder andere Netze gegen Entgelt.
Laut BGH-Entscheidung vom 4.3.2010 - III ZR 79/09, hier bezugnehmend auf die BGH-Entscheidung vom 15.11.2006 - XII ZR 120/04 ist diesbezüglich Mietrecht nach §§ 535 ff. BGB anwendbar.
Um diese Vertragsform anzunehmen, musste aber erst einmal die Streitfrage geklärt werden, ob Software eine Sache in Sinne von § 90 BGB darstellt oder nicht.
